iアプリ開発でのNDA その2

以前、iアプリ開発でのNDA というエントリを書いた。

これはこれで間違ってはいない。「iαppli Development Kit for DoJa-5.0 (FOMA)]使用許諾契約書」を素直に読むと色々出来なくなる。しかし、他で知った内容はこの限りではない。なぜなら、使用許諾契約書に同意しなくても良いから。

DoJa Developer Network　には英語だが色々な技術資料が公開されている。例えば、DoJa 2.5 API reference Ver.1.05 (.zip)　は Doja 2.5 の API がわかる。しかも、特に使用許諾契約とかを要求するボタンなども無い。

API リファレンスを展開して index.html を読むと最下部に次のように記載されている。

This product or document is protected by copyright and distributed under licenses restricting its use, copying, distribution, and decompilation. No part of this product or related documentation may be reproduced in any from by any means without prior written authorization of NTT DoCoMo (including other authors, if any). Third party software, including font technology, is copyrighted and licensed from the suppliers of this software.

これって、NDA には当たらないと思うわけです。私は。ということは、少なくとも Doja 2.5 のレベルでは例えば、Web にチュートリアルとか書いても、本を書いても問題ないように思う。

また、DoJa 2.5 Emulator Ver. 1.03 (.zip) の License Agreement には日本の場合には記述のあった、

第4条　禁止事項
（1~4項は省略）
5 お客様は、本ソフトウェアに関して知り得た弊社の技術情報その他一切の情報を本契約の目的外に使用したり、第三者に開示、漏洩することはできません。

に相当する条文が無いような気がするのだが...。まぁ、

2. RESTRICTIONS.
a. Software is confidential and copyrighted.

上記の「confidential」がそうとれなくもないが、日本文ほど明示的ではない。

うーむ。で、結論はどうなんでしょうね。素直に問い合わせればいいわけですが...。
